Agreement to these terms

These Terms of Service ("Terms") govern your use of the DogVita website at dogvita.nyc, any mobile applications we provide, and the dog-care services coordinated by DogVita ("DogVita," "we," "us," or "our").

By visiting our website, submitting a booking inquiry, creating an account, or receiving services from DogVita, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use our website or services.

Our services

DogVita provides premium dog-care services in New York City, including dog walking, home boarding, vet visit accompaniment, pet transportation, and membership plans that bundle recurring care.

Service availability is limited to the neighborhoods we currently cover, primarily Manhattan and select Brooklyn areas listed on our website. Coverage may change over time.

All services require consultation, onboarding, and confirmation by DogVita before care begins. Submitting a website booking request is an inquiry only and does not guarantee availability or create a confirmed appointment until we approve and schedule it with you.

Eligibility

You must be at least 18 years old and able to enter a binding agreement to use DogVita services or create an account on behalf of a household.

You represent that the information you provide is accurate and that you are the pet owner or have legal authority to arrange care for the pets listed in your account or booking request.

Booking and scheduling

Website booking requests collect details about you, your dog, and your preferred service so our team can follow up. We typically respond within 24 hours, but response times may vary.

Confirmed bookings, recurring schedules, and membership allocations are managed through DogVita after onboarding. We may decline or reschedule requests based on coverage, staffing, pet suitability, safety concerns, or operational constraints.

You are responsible for providing timely updates about access instructions, schedule changes, pet health changes, and any conditions that could affect safe care.

Pricing and payment

Service fees are quoted or confirmed before care is scheduled. Pricing may vary based on service type, duration, add-ons, membership plan, and other factors disclosed during booking.

Payments are processed through Stripe or other authorized payment partners. By providing a payment method, you authorize DogVita and its processors to charge fees for confirmed services, invoices, membership plans, and applicable adjustments.

Failed payments, chargebacks, or overdue balances may result in suspended service until resolved. Refunds, credits, and billing adjustments are handled according to the cancellation section below and our internal billing policies.

Cancellation and rescheduling

We ask for at least 24 hours notice when you need to cancel or reschedule a visit, whether you are a member or booking a one-time service. Contact us as soon as possible if plans change.

Late cancellations, missed appointments, or same-day changes may be subject to fees or forfeiture of included membership visits, depending on the circumstances and your plan.

If DogVita cancels or reschedules due to weather, staffing, safety, or operational reasons, we will work with you on an alternative time or appropriate credit where applicable.

Refund and credit amounts for paid bookings are reviewed on a case-by-case basis and may depend on timing, service type, and whether care was already in progress. DogVita may issue refunds to the original payment method, account credit, or another method we approve.

Client responsibilities

You agree to provide accurate and complete information about yourself, your pets, your home, building access, emergency contacts, and any health, behavior, or safety concerns that could affect care.

You are responsible for ensuring pets have appropriate collars, leashes, harnesses, identification, and any required medications or supplies for the scheduled service.

For transportation and vet visit services, you must provide authorization for intake, consent, and any procedures or handoffs required by the veterinary or service provider.

You must disclose aggression, bite history, escape risk, contagious illness, or other conditions that could endanger pets, caregivers, or the public. DogVita may decline or discontinue service if accurate information is not provided or if safety cannot be maintained.

Caregivers and service delivery

DogVita coordinates care through vetted caregivers and operational staff. We assign team members based on availability, coverage area, pet needs, and safety considerations.

DogVita remains responsible for coordinating the services you book through us. Caregivers perform services on DogVita's behalf according to our policies, training, and instructions.

Nothing in these Terms transfers ownership of your pet to DogVita. Custody during a visit, transport, or boarding stay is limited to what is necessary to deliver the requested service safely.

GPS, photos, and communications

During active visits, DogVita may provide live GPS tracking, visit updates, photos, and reports through the app or other channels. By using our services, you consent to these operational communications.

We may contact you by phone, email, SMS, push notification, or in-app chat regarding scheduling, service delivery, billing, safety, or emergencies.

Emergency features, including SOS alerts, may capture location or incident details to help our team respond. You agree to use these features responsibly and only for genuine safety concerns.

Assumption of risk and limitation of liability

Dog walking, boarding, transportation, and related pet care involve inherent risks, including injury, illness, property damage, encounters with other animals or people, and unpredictable behavior indoors or outdoors. You acknowledge these risks when using DogVita services.

To the fullest extent permitted by law, DogVita and its owners, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the website, app, or services.

DogVita's total liability for any claim arising out of or relating to these Terms or our services will not exceed the amount you paid DogVita for the specific service giving rise to the claim during the three months before the event occurred, except where a different limit is required by law.

You agree to indemnify and hold harmless DogVita from claims, losses, and expenses arising from inaccurate information you provide, your pet's actions, your violation of these Terms, or your misuse of the website or app.

Intellectual property

The DogVita website, app, branding, text, graphics, photos, and other content are owned by DogVita or used with permission and are protected by applicable intellectual property laws.

You may not copy, modify, distribute, or create derivative works from our content except as needed for personal, non-commercial use of our services. Visit photos and reports are provided for your personal use related to your pet's care.

Mobile app

DogVita offers or is rolling out mobile applications for clients and caregivers on iOS and Android. App availability may vary by device, region, and release stage.

Use of the app is subject to these Terms and to device permissions you grant, such as location, camera, notifications, and storage, which are needed for scheduling, visit tracking, photo updates, and safety features.

App store providers are not responsible for DogVita services and are third-party beneficiaries of any app store terms that apply to your download or use of the app.

Termination

You may stop using DogVita at any time. Membership plans may be canceled according to the terms communicated when you enroll. Unused included visits may remain available for the current billing period unless otherwise stated in your plan.

DogVita may suspend or terminate access to the website, app, or services if you violate these Terms, create safety risks, fail to pay amounts due, provide false information, or engage in abusive or unlawful conduct.

Sections that by their nature should survive termination — including payment obligations, liability limits, indemnity, and dispute terms — will continue to apply.

Disputes and governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

Before filing a formal claim, you agree to contact us at contact@dogvita.nyc so we can try to resolve the issue informally.

Except where prohibited by law, any dispute arising out of these Terms or DogVita services will be brought in the state or federal courts located in New York County, New York, and you consent to their jurisdiction.

Changes to these terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes may also be posted on our website or communicated through the app or direct notice where appropriate.

Your continued use of DogVita after updated Terms are posted constitutes acceptance of the revised Terms.
